Nowadays, companies are growing rapidly and so is the competition among them. Employees In the companies are working very hard and giving their best. Many employers are not satisfied with the amount of work their employees are giving and force them to work extra calling for irregular working hours and demand of unreasonable work. This can really disturb the employees and force them to resign their job.
Compelling employees to resign falls under constructive dismissal and the company might have to pay compensation to the employee if he files a claim against them. The ACAS constructive dismissal code makes the employees eligible for claim if they have worked at least two years in that company.
Some circumstances that lead to constructive dismissal
- Payment – people work to earn their living and it is very hard to survive without any source of income. In case your employer does not give you your salary on time or they always make delays ignoring your pay request then it might compel you to leave the job.
- Demotion – if you are working hard in a company and you are demoted without any reason, it can cause a serious effect on you. Doing nothing wrong or illegal then also getting demoted is a pathetic situation due to which many employees resign.
- Relocate without notice – relocating you to the other place or abroad without any prior notice can cause too much trouble and stress. You should be given a prior notice beforehand regarding any relocation. Employees get compelled to leave the job as they might not be able to relocate immediately.
